    TERMS AND CONDITIONS OF THE SAD will apply to all 99-lot owners in TPR. This is the fairest and most equitable solution. It will protect against the situation in a voluntary organization where only a few lot owners would bear the burden of costs to maintain the roads. We, collectively as lot owners, will determine the amount of assessment that we will be asked to pay. The assessment will appear on our respective real estate tax bills at the end of the year. The assessment will be collected by the County and held in a fund separate from the General Fund of the County.

    The assessment dollars can only be spent on TPR road maintenance, snow removal, related administrative and engineering services costs. The County will perform all administrative work to include but not be limited to collecting the funds, maintaining a checking account, paying bills, and providing audits as required by the state. The Taos Pines Ranch Road Special Assessment District Advisory Board (which will be the same as the Board of Directors of the Taos Pines Ranch Road Association (TPRRA) once formed) will be responsible for overseeing the work that is done and approving bills before the County will pay them. TPRRA will be responsible for obtaining the contractor to do the work and will be responsible for negotiating the contract for such services. TPRRA with the assistance of the County will pursue such contract through the County's public bid process. The SAD will be created with a term of 5 years. The reason for the 5-year term for the SAD is to ensure that we do not create something that is expected to last into perpetuity. In five years many political and pragmatic variables will change which should give us and the County pause to revisit our situation. Should we need to at that time, with approval of TPR lot owners, we will ask the Colfax County Commission to recreate the SAD for another specified time period.
